FitMatch – Terms & Conditions

1. Introduction

By downloading or using FitMatch (“the App”), you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree with any part of these terms, you must not use the App.

2. Description of Service

FitMatch is a mobile application that uses your device’s camera and artificial intelligence (AI) to:

  • Scan your body.

  • Generate accurate sizing suggestions.

  • Provide 3D avatar previews based on online store size guides.

3. User Consent

By using FitMatch, you grant permission to access your device’s camera and capture images and depth data solely for the purpose of body scanning and sizing.

4. Data Privacy

  • We respect your privacy.

  • All images, measurements, and 3D data collected are processed securely and temporarily stored.

  • No personal data is shared with third parties unless required by law.

  • We do not retain any biometric data after 30 days unless explicitly authorized.

  • We are not responsible for any hacking attempts on your device.

5. Payments and Subscriptions

  • Some features of the App may require a paid subscription.

  • Payments are handled via the Apple App Store or Google Play Store.

  • We do not store or process your payment details.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

6. Acceptable Use

You agree not to misuse the App or its services. You may not:

  • Use the App for unlawful purposes.

  • Reverse-engineer or attempt to extract the source code.

  • Upload offensive or illegal content.

7. Intellectual Property

All branding, content, graphics, and code within the App are the exclusive property of FitMatch or its licensors. No part of the App may be copied or reused without written permission.

8. Limitation of Liability

  • FitMatch provides estimates and suggestions only.

  • Measurements are approximate and based on your inputs.

  • We are not responsible for incorrect size matches, third-party product quality, or any losses resulting from purchases made based on app recommendations.

9. Changes to Terms

We may update these Terms and Conditions from time to time. Continued use of the App after such changes means you accept the new terms.

10. AI Accuracy Disclaimer

The size suggestions and 3D avatar renderings are AI-generated estimates. We do not guarantee 100% accuracy and are not liable for discrepancies in sizing or fit.

11. User-Generated Content

  • Users are responsible for any content they upload (images, scans, avatars).

  • Content must not be offensive, unlawful, or violate third-party rights.

12. Data Security Statement

FitMatch uses industry-standard encryption and security protocols. However, no system is completely secure, and users accept the inherent risks of data transmission.

13. Third-Party Integration Disclaimer

FitMatch may include links or API integrations with third-party stores (e.g., Amazon, Shein, H&M). We are not responsible for their content, pricing, sizing accuracy, or policies.

14. Service Termination Clause

We reserve the right to suspend or terminate any user account that violates these Terms or misuses the App and its data services.

15. Beta Features Notice

Some features may be in beta and subject to change, testing, or removal without notice.

16. App Store Terms Compliance

Use of this App is also governed by the terms and privacy policies of the Google Play Store and Apple App Store.
